Obligation to provide the data

The data requested in the forms on the Website are, in general, mandatory (unless otherwise specified in the required field) to fulfill the purposes for which they are being collected.

Therefore, if the User does not provide them or does not provide them correctly, the User's requests cannot be fulfilled, notwithstanding the fact that he/she may freely view certain contents of the Website.

Origin of the data

The data processed by DIRECTO for the purposes listed in the following section come from the User himself/herself through the various forms on the Website and from the use of the Website by the User and from his/her browsing of the Website (through cookies or data storage and retrieval devices), in accordance with the consents granted by the User to DIRECTO, if any.

For what purpose will Directo process the user's data?

DIRECTO will process the User's data for the following specific purposes:

  • Show recommendations through the extension: allow the extension downloaded by the User to detect accommodation searches on other websites and offer, in real time, cheaper or more relevant alternatives, thus improving your search and booking experience. 
  • Respond to the issues raised by the User through the contact channels provided: manage, process and support the requests, applications, incidents, complaints or queries made by the User through the various communication channels made available to the User.
  • Manage the registration and subscription of "Hosts and Hotels": manage the User's subscription, including the sending of communications related to the service and the attention to possible requests or incidents derived from the same.
  • Manage the candidacy of content creators: manage the process of analyzing and evaluating the profile of the interested party as a potential content creator for future collaborations with DIRECTO, which includes collecting information, contacting the candidate, and carrying out the necessary actions to evaluate his or her suitability.
  • Sending of commercial communications: to manage the sending of products and services marketed by DIRECTO related and/or unrelated to the Website, as well as those of other companies with which DIRECTO collaborates.
  • Elaboration of commercial profiles based on the information provided by the User to DIRECTO, in order to send commercial communications that may be of interest to the User. 
  • Commercial profiling of the User based on their preferences, using third party sources: (information obtained from the User's browsing on the Website, social networks: Facebook, Twitter, YouTube, Instagram and TikTok) to offer the User products and services according to their interests, if the User authorizes it by checking the box provided for this purpose. If the User so authorizes, this profiling will be carried out in an automated manner and will result in automated decisions so that the commercial communications received by the User are tailored to their interests, tastes and preferences. 
  • To comply with legally established obligations: when the processing is necessary to comply with a legal obligation derived from Spanish law or European Union law that may be applicable to DIRECTO (tax regulations, for example).
  • Preparation of reports, statistics and internal analysis to improve the services of the Website: analyze, manage and prepare internal reports and statistics on the behavior of Users to implement improvements to the Website, in any case, using aggregate information.

What user data will Directo process?

The User's personal data will be kept by DIRECTO for the followings periods:

  1. Show recommendations through the extension: the data will be kept as long as the User keeps the extension installed or has not withdrawn his consent. Once the extension has been withdrawn or the consent has been revoked, the data will be deleted, unless they must be kept blocked for the time necessary to meet possible legal liabilities.
  2. Data used to respond to questions raised through the contact channels provided the data will be kept for the period necessary to process and respond to your request and, once completed, during the period of limitation of legal actions arising from the request.
  3. Management of the "Hosts and Hotels" subscription: the personal data will be kept as long as the User keeps his/her subscription to the service active and does not request its cancellation. Once the subscription has been cancelled, the data may be kept, duly blocked, for the periods necessary to meet possible legal or contractual responsibilities.
  4. Manage the candidacy of content creators: The data will be kept for the time necessary to evaluate their candidacy and, if a collaboration is not established, for a maximum period of one (1) year.
  5. Data used for sending commercial communications: the data will be treated in accordance with this purpose until the User revokes consent.
  6. Data used for the elaboration of commercial profiles based on the information provided by the User to DIRECTO: the data will be processed in accordance with such purpose until the User opposes the processing and, in no case, will refer to a period longer than one (1) year.
  7. Data used for commercial profiling of the User based on his/her preferences, using third party sources: the data will be processed for this purpose until the User revokes his/her consent and, in no case, will refer to a period longer than one (1) year.
  8. To comply with the legally established obligations the data provided to comply with the obligations derived from the services offered by DIRECTO will be kept during the legally established terms.
  9. Data used to carry out the preparation of reports, statistics and/or analysis: the information will be used in aggregate form for the preparation of reports, statistics and analysis, during the period necessary to process and prepare the aforementioned reports, statistics and/or analysis, and, once this period has expired, during the period of limitation of the legal actions derived from the aforementioned request.

With which recipients will the user's data be shared?

All personal data provided by the User through the Website may be communicated to:

  • Public Administrations, in the cases provided by law, based on the fulfillment of a legal obligation.
  • Courts and Tribunals, in the cases provided by law, based on the fulfillment of a legal obligation.
  • Third party service providers that may have access to your personal data, which will process on behalf of DIRECTO the User's data, in order to provide services. DIRECTO follows rigorous supplier selection procedures in order to comply with its obligations in terms of data protection, including the subscription of the corresponding data processing contract in accordance with art. 28 of the RGPD.

International Transfers

Although the User's personal data is hosted on servers located within the European Union ("EU"), some services are operated from the United States ("U.S."), so certain User data may be accessed from the U.S. by DIRECTO and its service providers.

To ensure an adequate level of protection, DIRECTO carries out these transfers on the basis of appropriate safeguards, in particular by signing Standard Contractual Clauses (SCCs) adopted by the European Commission pursuant to Article 46.2(c) of the GDPR.

These clauses contractually oblige the recipient of the data to provide a level of protection equivalent to that required in the EU. Furthermore, additional technical and organizational measures have been implemented to protect the User's personal data against unauthorized access, loss, alteration or improper disclosure.

User's Responsability

The User guarantees that he/she is over fourteen (14) years of age and that the data provided to DIRECTO are true, exact, complete and updated. To these effects, the User is responsible for the veracity of all the data that he/she communicates and will maintain the information provided conveniently updated, in such a way that it responds to his/her real situation.

Likewise, he/she guarantees that he/she has informed the third parties from whom he/she provides his/her data, in case he/she does so, of the aspects contained in this document. Also, it guarantees that it has obtained its authorization to facilitate its data to DIRECTO for the indicated aims.

In any case, the User shall be liable for any false or inaccurate information provided through the Website and for any damages, direct or indirect, that this may cause to DIRECTO or third parties.

Exercise of rights

As the owner of the data, the User may send a letter to DIRECTO, at the address indicated in the heading of this Privacy Policy, or by e-mail to the address privacy@getdirecto.com at any time and free of charge. If DIRECTO should have reasonable doubts in relation to your identity, DIRECTO may request that you provide a photocopy of your national identity card or equivalent document proving your identity in order to exercise the following rights:

  • Right of Access: You shall have the right to be informed by DIRECTO whether or not it is processing your personal data and, if so, to have access to such data and to receive information on the purposes for which they are processed, the categories of data affected by the processing, the recipients to whom your personal data were communicated and the expected period of data retention, among other information.
  • Right of Rectification: You will have the right to request the rectification of inaccurate data concerning you when, among other reasons, such data are no longer necessary for the purposes for which they were collected.

  • Others: Likewise, you may file a complaint regarding the protection of your personal data before the Spanish Data Protection Agency at the address C/ Jorge Juan, 6, 28001 - Madrid, when the interested party considers that DIRECTO has violated the rights that are recognized by the applicable data protection regulations.

Security Measures

DIRECTO will treat the User's data at all times in an absolutely confidential manner and keeping the mandatory duty of secrecy with respect to the same, in accordance with the provisions of the applicable regulations, adopting for this purpose the necessary technical and organizational measures to ensure the security of your data and avoid its alteration, loss, processing or unauthorized access, taking into account the state of technology, the nature of the data stored and the risks to which they are exposed.

Changes

DIRECTO reserves the right to revise its Privacy Policy at any time it deems appropriate, in which case it will be communicated to Users. For this reason, we ask the User to regularly check this privacy statement to read the most recent version of DIRECTO's Privacy Policy.
